Dudek's April Winecki has helped numerous applicants secure environmental permits for California coastal zone projects. She offers the following insights from her experience helping applicants secure permits in a timely fashion while achieving the applicant's development objective:
#1 Coordinate early with California Coastal Commission (CCC) staff to address their concerns and identify the appropriate project design elements to avoid appeals.
#2 Work closely with local government and assist in its Local Coastal Plan/Coastal Act project consistency review process. Often, the local government and CCC address coastal issues in different ways. This can lead to misunderstanding and misinterpretation later in the process, resulting in an appeal. The more thorough the local government’s review and approval process, particularly relating to findings of project consistency with applicable Local Coastal Plan and Coastal Act policies, the less likely an appeal will be filed. Ensure the appropriate technical studies are conducted for projects to support policy consistency findings.
#3 Monitor the Coastal Commission's actions on similar project proposals to identify potential issues up front for project design consideration.
#4 Monitor the Coastal Commission's interpretations of Local Coastal Plan and Coastal Act policy statewide to help determine what changes in policy interpretation are occurring and anticipate how it may affect a project.
#5 Prepare appropriate technical studies and policy findings for projects to support required findings of approval.
#6 Evaluate Coastal Commission staff reports and recommendations to determine appropriateness and feasibility of findings and conditions of approval.
#7 Prepare Coastal Commission staff and Commissioner correspondence and participate in Commissioner meetings in response to staff reports/recommendations.
#8 Attend meetings with Coastal Commission staff and participate at Coastal Commission hearings.
